The quarrel began with a colleague of the murdered young man molesting a girl in the street, so Muhammad al-Banna tried to defend her out of magnanimity.

Following this incident, three young men stalked Mahmoud al-Banna, armed with canisters containing incendiary materials and a knife.

The two accused, Muhammad Rageh and Islam Awad, were stalked in Al-Banna on October 9 in a street in the city of Tala, and as soon as Al-Banna left a gathering of his friends, the first accused grabbed Mahmoud with the “knife” in his face, while the second accused puffed the young man in the face of the package containing a substance. incendiary. Rageh then struck al-Banna's face, followed by a stab in the upper left thigh. The two offenders fled on a bike driven by a third defendant.

As a result of Al-Banna's injury, he was transferred to Tala Central Hospital, but he died.

After investigations, the Public Prosecutor ordered that Muhammad Rageh and three other defendants in the case be referred to an urgent criminal trial, in order to charge them with the premeditated murder of Mahmoud al-Banna.

In an interview with Al-Arabiya.net, Mustafa Al-Bajs, the victim's lawyer, confirmed that "the statement issued by the Public Prosecutor on the case is in line with the steps taken by the Al-Banna family in the case."

He explained that the prosecution had attached documents to the indictment proving the incident, including an audio recording of the main defendant pledging to take revenge on Al-Banna, in addition to another verbal conversation, and videos of the scene surroundings proving the incident.

The investigations of the mabahith confirmed the existence of premeditation and surveillance by the first accused, as confirmed by the lawyer, who added: “We will demand that the maximum penalty be imposed on the accused.”

Mustafa Al-Bajis added, “The victim’s family and the Egyptian street are calling for a fair verdict, and we are confident in the integrity and justice of the judiciary, but we feel unfair regarding the “Child Law” that prosecutes juveniles according to Article 111, where no person is sentenced to death, life imprisonment, or rigorous imprisonment for those who have not exceeded the age of 18 years".

It is noteworthy that the four defendants in the case are under the age of 4, and therefore they will be tried according to the “Child Law,” which stipulates a maximum penalty of 18 years imprisonment.

It is not possible in any way to transfer the case to felonies and sentence the accused to death, as Article 111 of the “Child Law” (No. 12 of 1996) stipulates that no one who does not exceed the legal age (18 years) shall be punished with death.
